Business warns against resuming unscheduled inspections of subsoil users during the war

According to information from member companies of the European Business Association (EBA), the government plans to resume unscheduled state supervision measures in the field of geological exploration and rational use of subsoil resources by amending Cabinet Resolution No. 303 «On the termination of state supervision (control) measures under martial law.»  This is stated in the EBA’s statement.

EBA member subsoil users emphasize that the proposed changes create significant risks for market participants and may negatively affect the stability of their activities.

«Conscientious businesses are always ready for inspections, but in wartime, such control measures can pose a challenge to their operations,» the EBA statement said.

Conducting inspections will create additional pressure and obstacles for businesses that are already operating in extremely difficult conditions. Their reinstatement also contradicts the position of the State Regulatory Service of Ukraine. The latter has repeatedly refused to approve regulatory acts aimed at restoring state geological control during martial law.

In addition, the State Geological Service already has the ability to carry out appropriate control measures within the framework of current legislation without resuming unscheduled inspections.

Entrepreneurs are particularly concerned that the Cabinet of Ministers’ program of activities declares a principle of a long-term moratorium on business inspections, so the resumption of state control measures will effectively violate these declared priorities.

The EBA called on the government not to adopt draft resolution No. 303 of the Cabinet of Ministers regarding the resumption of unscheduled inspections of subsoil users.

We would like to remind you that in March last year, the European Business Association called for the rejection of the draft resolution of the Cabinet of Ministers on the resumption of scheduled inspections of subsoil users, which was previously published by the State Service of Geology and Subsoil of Ukraine.
